The terms of sale and delivery apply for products purchased on www.garmentproject.com is owned by Garment Project ApS

Payment and delivery

We accept payment with Dankort, Visa, Mastercard, Maestro, JCB and Diners Club. We do not deduct the amount until the product is shipped. In the case of a custom-made item, the payment will be deducted when fulfilment of the order commences. If you have ordered multiple products and one of the products is on back order, we do not deduct payment for the product on back order until it is shipped. The price of shipping is added to the listed price. You choose the form of shipping at the end of the payment process. A payment fee may be charged, depending on the chosen form of payment. Products will be delivered within 3-5 business days in the EU and 3-10 business days outside of the EU following your purchase. Delivery will be handled by either GLS or UPS

Any customs or import duties are charged once the parcel reaches its destination country. These charges must be paid by the recipient of the parcel. Unfortunately, we have no control over these charges, and cannot tell you what the cost would be, as customs policies and import duties vary widely from country to country.

The customer takes full liability for all postal charges, return shipment costs, customs charges and handling fees should they refuse to accept a parcel due to import duties or taxes.

Right of cancellation

The right of cancellation only applies to private consumers who purchase via www.garmentproject.com and not for purchases in our physical shop. Commercial customers do not have a right to cancel. You have the right, without providing a reason, to cancel an agreement up to 30 days after the day on which you or another person who has chosen (but not the shipping company) receives the product in your/their physical possession. If an order comprises multiple products and we cannot deliver the products at the same time, the right of cancellation applies from the time that you or another person who you have chosen (but not the shipping company) receives the last product in your/their physical possession. If the right of cancellation expires on a holiday, Saturday, Denmark's Constitution Day, Christmas or New Year's Day, the deadline will be extended until the following business day.

How to exercise the right of cancellation You exercise the right of cancellation by notifying us that you wish to cancel the order. For example, you can send a letter or an e-mail message with a notification of your cancellation to Garment Project, e-mail info@garmentproject.com You can also refuse to receive the product or simply not collect it at the Postoffice etc. You can use the law's standard cancellation form (use this link to the form www.retsinformation.dk/Forms/R0710.aspx), which is found at the end of the conditions, but it is not mandatory.

If you use the cancellation form, we will provide confirmation of receipt of the cancellation by e-mail. The cancellation form will be sent to you with our confirmation of the purchase. The right of cancellation is upheld if you send your notice of cancellation before the expiry of the cancellation deadline. Return of the product and return costs If you cancel the purchase of a product, you must send or return the product to us without undue delay and no later than 30 days after you have notified us that you wish to cancel your purchase. The deadline is met if you return the products before the expiry of the 30 days. Products may not be sent as billed on delivery or without delivery to the recipient's address. You must pay for the return of the products. When you return a product to us you must fill out our return form which you received along with your order. The return form must have all the required information, so we can identify your order.

Refunds

When you cancel a purchase, we refund the value of the product - not the shipping costs. The amount will be refunded without undue delay and in any event no later than 30 days from the date on which we receive notification of your cancellation. However, we can withhold the refund until we have received the returned products or until you have provided documentation of having returned the products. We will provide such refunds with the same payment method used by you for the original transaction. In any event, you will not be charged any fees in connection with the refund.

Partial cancellation

If you wish to cancel a portion of your purchase, shipping costs will not be refunded.

Inspection of product and packaging

You are only liable for any reduced value of the product caused by handling the product in excess of that necessary to determine the product's nature, characteristics and functionality. Normally, you may inspect the product in the same way that one is permitted and able to do in a shop, but you must not use it. Therefore, you must not remove any tags or the like. If you have used it in a way that one is not permitted or able to do in a shop, and we cannot sell the product again, or cannot sell it at full price again, you must expect that we will deduct the reduction in value from the amount refunded to you. If the product no longer has a commercial value, we will not refund the purchase amount. It is furthermore important that you do not damage the shoebox, since it is a part of the product. If the box is damaged - we may not accept the return. You must also ensure that the product is properly wrapped when you return it. You are liable for the package/products until we receive it. Therefore, save your shipping receipt and, if applicable, the track and trace number.

Claims – If something is wrong with the product If there is a defect in a product, e.g. an equipment or manufacturing defect, the provisions of the Danish Sale of Goods Act apply. You may submit a claim regarding defects in the product within 24 months from the time of delivery or by contacting us at info@garmentproject.com. We ask you to provide as much detail as possible about the problem. If the claim is warranted, we will refund your reasonable shipping costs. Remember that the product must always be shipped in protective packaging and that you must obtain a shipping receipt. Save your postal receipt, including information about shipping costs and, if applicable, the track and trace number.

Complaints If we cannot agree on the processing of a claim, you may submit a complaint to the Consumer Complaints Board:

WHAT IS YOUR INFORMATION USED FOR AND WHAT IS THE BASIS FOR OUR PROCESSING OF IT?

Our processing of personal information always has a legal basis. We use your personal information for the following purposes:

Supplying agreed goods/services
Communicating with you in connection with supplying our services
Individual marketing and targeting of tailormade offers and services which are relevant to you as a customer.


When you visit Garment Project, we automatically collect information on you and your use of our website, this is to optimise your experience as a user, and the functionality of the website and to allow us to undertake targeted marketing, including retargeting through e.g. Facebook and Google. This use may comprise, inter alia, surveys and analyses which are aimed at improving our products, the user experience, services and technologies as well as showing you content and advertising adapted to your interests and hobbies.


When you have signed up for our newsletter, we collect information such as your name, email address and your shopping habits. This is only for use on our website and we use it in relation to the personalisation of news, tips and offers. We send out approximately 2 to 4 newsletters each month and you may always unsubscribe by clicking the link at the bottom of the email or by sending an email to info@garmentproject.com.


The legal basis for the processing is found in Article 6 of the General Data Protection Regulation, specifically section 1, para b) concerning the fulfilment of a contract, para c) concerning mandatory legal obligations such as storage of transactional information pursuant to the Danish Act on bookkeeping and para f) on the pursuit of legitimate interests, which mean the ongoing improvement of products, services and shopping experiences as well as the registration of your preferences, etc. in order to be able to target our discount campaigns and advertising to you with a view to improving your user experience. Additionally, we process your personal information pursuant toArticle 6, section 1, para a) of the General Data Protection Regulation when you have provided your express consent as a reader of our newsletters or as a customer at our webshop.


Providing personal information may be necessary if we are to supply products, which you have purchased in our web shop. We cannot supply our products unless you provide us with the required information.

WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

Garment Project uses data processors, to include providers of software, web hosting, social and professional backups, security and storage. For this reason, your personal information will be processed by third parties instructed by Garment Project. The data processors only process your personal information for the specific purposes, for which the information has been collected and on the basis of the data processing agreements entered into between Garment Project and the data processor. We require all data processors to process your personal information confidentially and in accordance withapplicable law.

WHEN DO WE TRANSFER PERSONAL DATA TO COUNTRIES OUTSIDE THE EU/EEA?


Some data processors, e.g. Google Analytics by Google LLC and Facebook Inc. are based in the USA. The required guarantees in relation to the transfer of information to the USA have been secured through the certification of the data processor under EU-U.S. Privacy Shield, cf. Article 45 of the General Data Protection Regulation.

FOR HOW LONG DO WE STORE YOUR INFORMATION?

According to the Danish Act on bookkeeping, we store your information for a period of five (5) years from the end of the financial year, to which the transaction relates.

ACCESS, RECTIFICATION OR ERASURE OF PERSONAL INFORMATION

You have the right to be informed of the nature of the personal information on you, which is processed by us. Moreover, at any time, you may object to the use of information. You may also object to the processing of your information for the purposes of direct marketing. You may also withdraw your consent to the processing of your personal information. If the personal information which is processed is wrong, you have the right to rectify or erase the information. In certain instances, you also have the right to data portability, which means that you receive your personal information in a structured format, which is in general use, and, additionally, you have the right to have this information transferred to another data controller.
